1. Purpose and scope

These terms govern the use of the Market, the card resale space between private individuals available on mintcards.ch. They are separate from and independent of the general sales terms of the mintcards.ch shop. By using the Market, whether as a seller or a buyer, you accept these terms in full.

The Market is operated by D.G.E. Concept Sarl, whose registered office is in Arzier-Le Muids (canton of Vaud, Switzerland), business identification number CHE-456.471.738, hereinafter the Operator. Contact: admin@dgeconcept.ch.

2. Definitions

The Market

the space that connects members for the resale of cards.

Seller

the member who publishes a listing to sell a card.

Buyer

the member who acquires a card through a listing.

Listing

the offer to sell published by a seller.

Commission

the remuneration owed to the Operator when a sale is concluded.

3. Role of the Operator

The Operator provides a hosting and matchmaking service. It is neither the seller, nor the buyer, nor a party to the sale contract concluded between members. The sale contract is formed directly between the seller and the buyer.

The Operator never holds the card, does not collect the price of the card, does not handle its packaging or shipping, and offers no escrow service or guarantee of successful completion of the transaction. Its role is limited to hosting and moderating listings, recording the purchase, and invoicing its commission to the seller.

4. Access and account

Access to the Market, whether to sell or to buy, requires a valid customer account on mintcards.ch. Guest purchases are not possible.

The member must be at least 18 years old, or have the consent of their legal representative, and have the capacity to contract. The member undertakes to provide accurate information and to keep their details up to date.

5. Seller verification and profile

Before being able to publish a listing, the seller must have a complete profile and have verified their identity. A complete profile includes the civil identity, a postal address, a telephone number and at least one fully specified payment method. Until the profile is complete and the identity verified, publishing listings is not possible.

Identity verification takes place once per seller, by means of an official identity document and a selfie with liveness detection, in order to protect buyers and ensure the reliability of the Market. It is carried out by a specialised third-party provider; the identity and biometric data required for the verification are processed by that provider and are not retained by the Operator, which keeps only the verification status and its date. The “verified seller” badge shown on listings only attests that a verification has succeeded and does not constitute a guarantee by the Operator as to the transaction, the card, or the seller's conduct.

6. Publishing a listing

The seller provides in particular the title, the description, the card type, from 1 to 5 real photos of the card, the sale format, the price, the shipping costs, the payment methods they accept and their payment details. At least one real photo is mandatory. The description and the photos must be accurate and faithfully reflect the actual condition of the card.

Every listing is subject to moderation before going live. The Operator may refuse or remove a listing, without compensation, in particular in the event of a non-real photo, a misleading description, an inappropriate pseudonym, or a counterfeit, unlawful card or one infringing third-party rights.

7. Sale formats

Fixed price

the buyer acquires the card at the displayed price.

Fixed price with offer

the buyer may propose an amount. Any offer below 60% of the displayed price is automatically refused. Above that threshold, the seller accepts or refuses. Acceptance takes place on the site.

Auction

ascending auction, with automatic bidding by maximum amount, anti-sniping extension at the end of the auction, and a buy-now option available as long as the bids have not reached the buy-now price.

8. Price, shipping costs, payment and delivery

The price of the card and the shipping costs are set by the seller and displayed in the listing. The payment methods accepted by the seller are also indicated in the listing, so that the buyer is aware of them before bidding or buying. Payment for the card and its shipping take place directly between the buyer and the seller, off the platform. The Operator is not a party to this payment or delivery and cannot be held liable for it.

As soon as the purchase is recorded on the site, the seller's payment details are disclosed to the buyer so that they can pay the price. In their account, the buyer finds a summary of the transaction (seller, date, price, seller's details and accepted payment methods) and can confirm receipt of the card there. The seller undertakes to ship the card in accordance with the listing; the buyer undertakes to pay its price.

9. Commission

No fee is due on publication. A commission is owed by the seller, and by the seller alone, when a sale is concluded. It amounts to 6% of the price actually paid (fixed price, accepted amount or hammer price), with a minimum of CHF 0.50 and a maximum of CHF 250. Shipping costs are not included in the commission base. The commission is exclusive of VAT.

After the sale, a 7-day return window allows the buyer to confirm receipt of the card, rate the transaction or report a problem. When the buyer confirms receipt, or at the end of this window in the absence of a problem, the commission becomes due and is invoiced to the seller with a payment link (card, TWINT or QR-bill). If a problem is reported or the sale does not complete, the commission may be cancelled.

The balance of commissions due accumulates on the seller's account. The Operator may send reminders to the seller and block the publication of new listings beyond an unpaid threshold, until the situation is regularised.

10. Modifying and withdrawing a listing

The seller may modify or cancel their listing as long as no bid or offer has been received. A modified listing is moderated again. From the first bid or offer received, the listing is locked.

11. Public pseudonym

The seller is publicly identified by a pseudonym. Their civil identity is not shown to other members. The pseudonym must not contain circumvention contact details, offensive terms, or usurp a trademark or the identity of the Operator. The pseudonym becomes fixed upon the first published listing; the Operator may change it in the event of abuse.

12. Ratings

After a transaction, the buyer may rate the seller from 1 to 5, without free comment. Only an aggregated average is displayed publicly, from a minimum number of rated sales. This rating serves a purpose of trust between members and of moderation.

13. Card conformity, warranty and liability

The seller describes the card and provides real photos of it under their sole responsibility. They are responsible for the conformity of the delivered card with their description and photos. The Operator does not verify and does not guarantee the accuracy of the description, the photos or the condition of the card.

As the card is sold directly by one private individual to another, the statutory warranty for defects within the meaning of articles 197 et seq. of the Code of Obligations applies in the relationship between the seller and the buyer, and not vis-a-vis the Operator, which is not a party to the sale. The seller and the buyer may, within the limits of applicable law, agree on the extent or the exclusion of this warranty with regard to the condition of the card.

The Operator is not liable for transactions concluded between members, for the quality, authenticity or condition of the cards, for payment, for shipping, or for disputes between members. Its liability is limited to the provision of the hosting and matchmaking service, within the limits permitted by applicable law.

14. Prohibited content

The sale of counterfeit or stolen cards, or of cards infringing intellectual property rights or third-party trademarks, as well as any misleading listing, are prohibited in particular. The Operator reserves the right to remove any listing and to suspend any offending account.

15. Moderation and suspension

The Operator moderates listings at entry and may suspend a seller in the event of repeated problems. Suspension prevents the publication of new listings and removes current listings, while allowing transactions already underway to complete. The decision is always made by the Operator, never automatically.

16. Personal data

Members' data are processed in accordance with Swiss data protection legislation (revised FADP). The seller's payment details are disclosed to the buyer only after the purchase, for the purposes of the transaction. Data processing is detailed in the mintcards.ch privacy policy.

The verification of sellers' identity (article 5) is carried out by a specialised third-party provider. The identity and biometric data required for this verification are processed by that provider and are not retained by the Operator, which keeps only the verification status and its date.

17. Amendment of the terms

The Operator may amend these terms. The applicable version is the one in force at the time the listing is published or the purchase is made. Members are informed of significant changes by the update of this page and, where applicable, by email.

18. Governing law and jurisdiction

These terms are governed by Swiss law. The place of jurisdiction is that of the Operator's registered office, in the canton of Vaud, subject to the mandatory provisions protecting consumers.
