1. Scope of Application

These General Terms and Conditions of Sale (the "Terms") govern any order placed on the website mintcards.ch with:

D.G.E. Concept Sàrl (brand MintCards.ch), Rue du Village 8b, 1273 Arzier-Le Muids, Switzerland. VAT No. CHE-456.471.738. Email: admin@dgeconcept.ch (the "Seller").

By placing an order, the customer (the "Customer") accepts these Terms without reservation. Any conflicting condition of the Customer is only binding if the Seller has accepted it in writing.

2. Products and Availability

Products are described with care. Visuals (card illustrations, photographs) are indicative and may present slight differences from the delivered product. Offers are valid within the limits of available stock. In case of unavailability after order, the Seller informs the Customer and reimburses the amounts already collected for the product in question.

3. Price

• Prices are stated in Swiss francs (CHF) and constitute the final price to be paid.
• As the Seller is not subject to VAT, no value added tax is charged or mentioned.
• Shipping costs are indicated separately before order validation and are added to the product price.

The Seller reserves the right to change prices at any time. The applicable price is the one displayed at the time of order validation.

4. Order and Contract Conclusion

The presentation of products constitutes an invitation to order and not a firm offer. The Customer's order constitutes an offer to purchase. The contract is concluded when the Seller confirms the order, at the latest upon shipment. The Seller may refuse or limit an order for just cause (stock exhausted, suspicion of abuse, manifest price error).

5. Payment

Payment is made by the methods offered at the time of order: bank transfer (QR invoice); TWINT, Visa, Mastercard, Apple Pay and Google Pay via our secure payment provider myPOS; as well as PayPal. In case of payment by transfer (QR invoice), products are only shipped after receipt of the full amount. The Seller retains ownership of the products until full payment of the price (retention of title, art. 715 CC).

6. Delivery

• Delivery is made
• exclusively in Switzerland, by Swiss Post. Delivery times are indicative and communicated at the time of order. They depend on the shipping method and, for QR invoice payments, on receipt of payment.
• Shipping costs are calculated according to the weight and format of the shipment and displayed before order validation.
• The risk of loss or damage in transit passes to the Customer upon delivery of the product to the carrier, subject to mandatory consumer protection provisions.

In case of damaged or undelivered parcels, the Customer contacts the Seller as soon as possible to find a solution.

7. No Right of Return

Swiss law does not provide for any legal right of withdrawal for online sales. No returns or exchanges for convenience (change of mind) are accepted. In particular, opened boosters and cards that have already been revealed cannot be returned or exchanged, as their value and integrity depend on their sealed or unrevealed condition.

8. Warranty: cards and accessories

Cards. All cards, whether sold sealed, in box, in booster or individually, are sold without right of return, refund or exchange, and without warranty. The random nature of the contents of sealed products, as well as the condition and appearance of the cards, including any imperfections or print variations, are inherent characteristics of this type of product, known and accepted by the Customer at the time of purchase.

Accessories. For accessories (for example sleeves, binders and other items not consisting of cards), the Seller is responsible for material manufacturing defects present at delivery, by replacement or refund at its discretion, to the exclusion of any other compensation within the limits permitted by law.

Order execution. The above exclusion does not relieve the Seller of the obligation to deliver the ordered product. In case of non-delivery, or delivery of a product different from the one ordered, the Seller shall proceed with reshipment or refund. This is order execution, not a warranty on cards.

Mandatory provisions remain reserved, in particular the inability to exclude warranty in case of intentionally concealed defects (art. 199 CO).

9. Liability

Within the limits permitted by Swiss law, the Seller's liability is limited to direct and foreseeable damage. All liability for fraud or gross negligence, as well as mandatory provisions in favour of consumers, remain reserved.

10. Data protection

Customer data is processed in accordance with our Data protection declaration and the Federal Act on Data Protection (FADP).

11. Amendment of Terms and Conditions

The Seller may amend these Terms and Conditions at any time. The Terms and Conditions applicable to an order are those in force at the time of its validation.

12. Applicable law and jurisdiction

These Terms and Conditions are governed by Swiss law. Jurisdiction is at the Seller's place of business, subject to the mandatory jurisdiction of the consumer's domicile in Switzerland.
